The following information is provided for your guidance in court appearance:
YOU HAVE THE RIGHT TO OBTAIN AN ATTORNEY AND/OR A SUPPORTING DEPOSITION IF YOU SO CHOOSE.
IF YOU HAVE BEEN CHARGED WITH A MISDEMEANOR OR A FELONY, YOU MUST APPEAR IN COURT FOR ARRAIGNMENT. UPON FAILURE TO APPEAR, AN ARREST WARRANT WILL BE ISSUED. YOU MAY BE ELIGIBLE FOR A PUBLIC DEFENDER TO REPRESENT YOU AFTER FILING A FINANCIAL AFFIDAVIT AT COURT.
After receiving a vehicle and traffic violation, you must either submit your plea in writing to the court or appear in person at court on your scheduled court date which is at the Wayland Town Hall, 17 N. Main Street, Wayland, NY 14572 If your court date is scheduled for a Wednesday, you have been assigned Justice Thomas C. Recktenwald who holds court at 9:00 a.m. the first four Wednesdays of each month. If you are scheduled for a Thursday, you have been assigned Justice Kerry D. Pebbles who holds court at 5:30 p.m. the first and third Thursdays of each month. Upon failure to submit a plea to the court, your license will be suspended for failure to appear/comply and an additional mandatory $ 70.00 suspension lift fee will be imposed on each ticket.
Once the court has received your plea either in person or in writing, the ticket will be processed. If a PLEA OF GUILTY is submitted a fine and mandatory surcharge will be imposed by the judge after his review of the case. If a plea of NOT GUILTY is submitted, a pre-trial conference date will be scheduled with the district attorney. After you have completed the information that the district attorney requires and followed all directions according to their policies, your case will be reviewed by the assistant district attorney, Bonita Stubblefield. If she has a recommendation, she will notify you in writing before your upcoming pre-trial conference date. If there are no recommendations made, or you do not agree with a recommendation that she has made, a trial date will then be scheduled at which time you must appear at court. If at any time you choose to change your plea to guilty, you may do so in writing to the court. If we do not have any response from you by the date of your pre-trial conference, a trial date will be scheduled. If you agree with the district attorney's recommendation, you need to sign the affidavit from the district attorney and return it to the court for processing.
Once a fine is imposed and a due date scheduled, you must pay your fine in full by this date. If you have special circumstances which require additional time, it is imperative that you contact the court immediately. If your fine is not paid your license will be suspended for failure to pay. There will be an additional mandatory $ 70.00 suspension lift fee imposed on each ticket once you are suspended by the NYS Dept. of Motor Vehicles. DO NOT SEND SUSPENSION FEES UNTIL YOU DETERMINE WHETHER YOU ARE INDEED SUSPENDED BY THE STATE OF NEW YORK AT THE TIME OF PAYMENT. IF YOU ARE NOT SURE, CONTACT THE COURT.
NO PARTIAL PAYMENTS, INCORRECT PAYMENTS OR PERSONAL CHECKS WILL BE ACCEPTED. PAYMENT MUST BE MADE BY CERTIFIED CHECK, MONEY ORDER OR CREDIT CARD ONLY.
